After a great deal of arguments learned counsel for the parties have agreed as under:-
1. That the petitioner shall vacate the demise shop within one year on or before 2.10.2008, in case of failure, without notice to the petitioner, landlord shall proceed to execute writ of ejectment against the tenant through police aid, by breaking open the lock.
2. In view of the above position, execution application No. 9/2000 shall remain suspended till 2.10.2008.
3. At the time of vacation of demise shop, landlord will refund security amount of Rs. 1,43,000/- to the tenant in shape of pay order directly.
4. Tenant/petitioner shall continue deposit monthly rent, in the Court of Rent Controller.
No. S. 230 of 230/07 stands disposed of, in above terms with the consent of the learned counsel for the parties. Parties are left to bear their own cost. .
