MUHAMMAD KHALID ALVI, J.--- Petitioner was appointed as Naib Qasid in the office of T.M.A. On 4- 10-1993. On 30-9-2004 he was promoted as Junior Clerk in BPS-5 and the entry was also made in his service book. He performed his new duty continuously up-to-date but the pay being disbursed to the petitioner was of BPS-1. Despite repeated requests his grievance was not redressed, therefore, he was constrained to file the instant petition.

Learned counsel for respondents Nos.1 and 2 concedes that petitioner was promoted w,e,f, 30-9- 2004 and since then he is performing his duty as Junior Clerk in BPS-5 but his pay is being disbursed in accordance with BPS-1 because the matter was not cleared by the respondent No,3 on account of various queries. However, respondents Nos.1 and 2 then again passed a fresh order on 30-8-2006 with regard to his promotion, despite that, the grievance of the petitioner is still at the same stage. Tariq Ismail, Director, Local Funds Audit present in Court states that queries with regard to the order, dated 30-9-2004 have been clarified and he has no objection to the payment of the salary to the petitioner in BPS-5 w,e,f, 30-9-2004 provided the subsequent orders by respondents Nos.1 and 2 dated 30-8-2006 are withdrawn.
3. Learned counsel for respondents Nos. I and 2 states that in view of the statement made by Director Local Funds Audit, respondents Nos.1 and 2 are ready to withdraw order dated 30-8-2006.
4. In view of the above situation, this petition is allowed. The respondents are directed to make payment of salary to the petitioner in BPS-5 v .e.f. 30-9-2004.
