1. ' JUSTICE. (RETD.) TANVIR AHMED, KHAN (CHAIRMAN/ RITU).--- Facts briefly for the disposal of this petition are that through my order dated 19th of September, 2006, I directed Mr. Ghulam Nabi Deeshak, Deputy Registrar, Karachi Bench to hold the referendum through secret ballot in the establishment of UBL Sindh-Balochistan (CBU) for determination of CBA. He embarked upon the proceedings and held many meetings with the contesting unions as well as the management.
2. Ultimately the referendum was held on 18-11-2006 wherein following two unions participated in the referendum:-
(i) U.B.L. Workmen Union Sindh-Balochistan.
(ii) U.B.L. Mazdoor Ittehad Union Sindh-Balochistan.
3. ' However, the third union in the establishment namely U.B.L. Labour Union did not participate in the referendum. The result was announced whereby the former union i,e, U.B.L. Workmen Union secured 545 votes out of 693 votes. While U.B.L. Mazdoor Ittehad Union secured only 7 votes which is less than 15% of polled votes. The third Union i,e, U.B.L. Labour Union, as already stated never participated in the referendum. In spite of notice nobody has turned up from both the unions. Accordingly in view of the mandatory provisions provided under section 12(3)(ii) and (iv) of the IRO, 2002, I have got no other option but to cancel the registration of U.B.L. Mazdoor Ittehad Union having secured 7 votes which is less than 15% of polled votes and U.B.L. Labour Union being not the contestant in the referendum. Accordingly the registration of these two unions is cancelled. They are directed to surrender their registration certificates within one month.
