' This appeal is directed against the order, dated 6-4-2006, whereby on reference made by Federal Government under section 54 of IRO 2002, the learned Chairman NIRC declared and certified all the establishments of UBL situated in the Province of Sindh and Balochistan as one CBU and Provinces of Punjab, N.-W.F.P. And Federal Capital territory the other CBU for a period of 5 years and directed all the trade unions registered with the Provincial Registrars or with the NIRC to amend their constitution through opening their membership to the workers employed in the respective CB-Us within one month failing which they would be deemed to be non-existent.
2. ' We have heard Mr. Hafeez Shah, General Secretary of the appellant union and Mr. Faisal Mehmood Ghani, learned Advocate for the respondents.
3. ' It appears that the petitioner union was registered with Provincial Registrar of Trade Union Sindh Karachi. Consequent to order, dated 6-4-2006, which is impugned in the present appeal, the appellant union extended its membership to the Province of Balochistan and applied for its registration to the RITU in respect of Sindh and Balochistan CBU. The appellant union was registered as Industry-wise trade Union by the learned RITU vide order, dated 14-6-2006 passed in Case No,3(11) of 2006 and referendmum was held for CBA in the establishment of UBL Sindh-Balochistan (CBU). The appellant union did not contest in the referendum, as such its registration was cancelled by the learned Chairman/RITU by order dated 23-1-2007 under section 12 (3)(H) of the IRO, 2002, passed in Case No,2(2) of 2006, the copy whereof has been placed before us while advancing the arguments by. Mr. Faisal Mehmood Ghani Advocate for the respondents. Mr. Faisal Mehmood Ghani, Advocate for the respondents, therefore has contended that since the registration of the appellant union has been cancelled, as such it has lost its locus standi to pursue the appeal. Mr. Hafeez Shah, General Secretary of the appellant union has not been able to advance any submissions to meet the legal objections raised by Mr. Faisal Mehmood Ghani, Advocate for the respondents.

' In these circumstances we are of the view that since registration of the appellant union has been cancelled under section 12(3)(ii) of the IRO, 2002 by the learned Chairman/RITU by order, dated 23- 1-2007 passed in Case No,2(2) of 2006 as such the appellant union does not continue to possess any locus standi to pursue the appeal, which accordingly stands dismissed. With short order the appeal was dismissed and these are the reasons for the same.
