1. The original record of the case No, 10/2007. There is no cavil to the legal proposition that a person once tried can not be tried or can not be asked to face identical allegation for which he has already been acquitted/ sentenced, as it amounts double jeopardy/ vexation which is barred by article 13 of Constitution of Pakistan 1973 ( amended up to date). Beside this similar principal laid down under Section 403 Cr. P.C and 11 CPC, hence in view of the above stand principal, this court has no other option to terminate the proceeding of this case. File be consigned to record room.
