1. Sh. Ghulam Ahmed, Advocate, complainant filed complaint in hand under section 25 Punjab Consumer Protection Act, 2005 with the prayer that the respondent be directed to hand over the swing machine which is lying in his shop for repair to the complainant forthwith and he be also directed to pay the damages to the complainant.

2. Brief facts necessary for the disposal of this complaint are that complainant purchased a swing machine model No. IXI 5KVBI form the respondent in consideration of Rs. 3375/- vide receipt No. 142766 dated 25-02-07 with warranty of one year. The swing machine was out of order therefore on 03-06-07 the same was handed over to the respondent for its repair. The complainant approached the respondent and asked for the delivery of the swing machine on numerous occasions but the respondent on one pretext or the other refused to deliver the same and in this way the conduct of the respondent was not only proper but was humiliating, therefore the complaint in hand arises.

3. The respondent was summed and he put his appearance on 14-06-07 and the copy of the complaint was supplied to him. The complainant filed an application under section 29 of the Punjab Consumer Protection Act, 2005. Both the parties were directed to make a firm written offer for settlement stating the condition offered for settlement. Through the written offer the respondent submitted that he is willing to hand over the swing machine to the complainant more over he is ready to tender apology from the complainant and he present himself at the mercy of court. The complainant accepted the terms and conditions offered by the respondent and he further requested that he did not want to further prosecute the respondent.

4. In view of the written settlement the respondent handed over the swing machine to the complainant and he received the same after checking and verification. The grievance of the complainant has been redressed and he did not want to further prosecute the respondent therefore this complainant is disposed off. The respondent is directed to be careful in future.

5. File be consigned in the record room after due completion.
