1. ' JUSTICE (RETD.) TANVIR AHMED (CHAIRMAN/RITU).--- Earlier a Case bearing No,20(6) of 2003 was filed under subsection (1) of section 12 of I.R.O., 2002 by the Deputy Registrar (Registration) under authorization by the learned Ex-Chairman/RITU (Mr. Riaz-ul- Hassan Alvi) for initiation of cancellation proceedings against U.B.L. Employees. Federation of Pakistan being violative of its own constitution and provision of I.R.O.
2. 2002. The Labour Court of this Commission heard the case on different dates. However, through an order, dated 20-5-2006 the learned Labour Court comprising of Messrs Raja Abdullah Khan and Muhammad Shabbir Jamal, learned Members referred the case to me on the request of the complainant because of changed circumstances as a result of declaration of two C.B.Us. In the establishments of U.B.L. According to the complainant, the changed circumstances have the compelling effects to deal the instant Federation under different provision of law. Hence this case.
3. ' I have gone through the record pertaining to U.B.L. Employees Federation of Pakistan. The record demonstrates that the said Federation was registered in the year 1974 vide Registration Certificate No,8/74 at national level consisting of locally registered trade unions. The A Federation functioned actively till 1998 when last election was approved for two years but after expiry of tenure of two years no election was conducted which is violation of its own constitution. In addition to non- holding of election, the federation also failed to submit Annual Returns. These violations require judicial scrutiny by the Labour Court. However, the instant case has taken new turn after declaration of two C.B.Us. In the establishment of U.B.L. According to the said order all the local registered trade unions which were affiliated with the federation amended their respective constitutions in accordance with section 54 of I.R.O., 2002. The record shows that 35 unions were registered at local level in the establishment of U.B.L. U.B.L. Employees and Workmen Union and U.B.L. Employees and Workmen Union (Shaheen) applied for Punjab, N.-W.F.P., Islamabad C.B.U.
4. While U.B.L. Workman Union, United Bank Labour Union and United Bank Mazdoor Ittehad Union applied for Sindh Balochistan C.B.U. Only two unions till date have been registered in each C.B.U.
5. The other unions who have not so applied ceased to exist. As the U.B.L. Employees Federation of Pakistan has no affiliated unit and has become ceased to exist. I, in exercise of power conferred on me under section 12(3)(I) of I.R.O., 2002, the registration of U.B.L. Employees Federation of Pakistan, cancelled the registration of U.B.L. Employees Federation of Pakistan and direct the Deputy Registrar (Registration) to ask the office-bearer if any to surrender the original Registration certificate of the
