1. AMIR HANI MUSLIM, J.--- The applicant is facing trial in Crime No,156 of 2006, under sections 392, 337-H(ii) read with section 34, P.P.C. With Police Station Shah Latif Town. The applicant was arrested on 25-6-2006 since then after completion of the investigation was remanded to judicial custody.
2. The challan has been submitted however, the charge has not been framed. It is not in dispute that the applicant has not been arrested from the spot, but was being chased and arrested after half an hour. In the intervening period one of the co-accused namely Abdul Jalil was arrested from the spot and he also disclosed the name of the applicant. No recovery of the robbed articles has been effected from the applicant except TT pistol.
3. ' Learned A.A.-G. For the State has opposed to the grant of bail to the applicant.
4. Since the applicant has not been arrested from the spot and no recovery of robbed articles has been effected. The applicant is in jail for more than eight months and even charge has not been framed. This prima facie is case of further inquiry and I, therefore, grant bail to the applicant in the sum of Rs,1,00,000 (Rupees one hundred thousand only) with P.R. Bond in the like amount to the satisfaction of the trial Court.
