ORDER

'MUHAMMAD MUZAMMAL KHAN, J. --- Instant first appeal assailed ejectment order dated 18.3.2006 passed by the learned Additional Rent Controller, Walton Cantonment, Lahore, whereby appellant was ordered to be evicted from House No. 452-GG, Phase-IV, D.H.A., Lahore Cantonment, on the basis of default in payment of rent and bona fide personal need of the respondents/landlords.

Learned counsel for the parties, after arguing their respective cases, decided inter se that this first appeal may be dismissed but order of ejectment dated 18.3.2006 passed by the learned Additional Rent Controller may be suspended for six months i.e. Till 08.03.2007, subject to payment of future rent at the rate of Rs. 20,000/- per month by the appellant against a receipt.

3. - Since compromise/settlement between the learned counsel who settled the things under instructions of their respective clients, is lawful, the same is accepted and the instant appeal is dismissed with the result that order of eviction of the appellant dated 18.3.2006 shall remain suspended for six months i.e. Till 08.03.2007, subject to payment of future rent at the rate of Rs.

20,000/- per month against a receipt or remittance through money order etc. Default on part of the appellant, even of one month would revive the ejectment order above-referred and rescission of this order automatically. Appellant would hand over vacant possession of the house in question on or before 08.03.2007 and in case of his failure the ejectment order dated 18.03.2006 will have its legal course. There will be no order as to costs of this appeal.
