ORDER

' SALIM KHAN, J.-The learned counsel for the petitioner contended that, though the response was made by TESCO, the reply was evasive and did not solve the problem of the petitioner.

2. After some discussion, the learned counsel for the petitioner submitted that the petitioner would be satisfied if the present petition is converted into a reference to the Political Agent of Khyber Agency and sent to him with the direction to decide the same regarding the payment of compensation to the petitioner within a period of three months.

3. It is not clear at this stage whether the law relating to acquisition of lands is or is . Not applicable to the Federally Administered Tribal Areas but rfo person can be deprived of his property except in accordance with law. The request of the petitioner as mentioned above is genuine, and is hereby accepted. The Political Agent of the Khyber Agency is directed to consider the present petition as a reference to him in accordance with the established principles of law. Arid decide the same within a period of three months in accordance with such established principles.

4.The petition is disposed of accordingly, but with the direction to the office to send the original to the Political Agent Khyber Agency by retaining its copies on the file. revisions by the competent authorities.
