ORDER

MUHAMMAD MUZAMMAL KHAN, J. --- Referring to his application filed by him under Order XXXVII, Rule 2 of the C.P.C., inter alia, contends that there was an allegation that promissory note, on the basis of which suit has been filed, was a forged document. The learned Additional District Judge has erroneously said that the application does not mention, even a single word in support of the application. Further submits that the learned Additional District Judge while non-suiting the petitioner has grossly misread the pleading as well as the evidence on the file.

2. Point raised needs consideration. Admit. Notice for a date in the last week of January, 2004.

3. Subject to notice, judgment and decree dated 11.9.2003, passed by the learned Additional District Judge, shall remain suspended.
