' MUHAMMAD FARRUKH MAHMUD, J.---Instead of pressing this petition the learned counsel for the petitioner submits that he would seek redress of his grievance by way of filing a complaint.
Disposed of accordingly.
2. In case a complaint is filed by the petitioner the same would be decided strictly on its own merits.
The learned Trial Court would not be influenced by the opinion of the police or by the observation made by the learned Magistrate in his order, dated 23-11-2004 as the learned Magistrate has wrongly based his order on the opinion of the arbitrators which practice was not approved by the apex Court in the case of Mst. Bashiran Bibi v. Nisar Ahmad Khan and others (PLD 1990 SC 83).
