ORDER

1. ' The learned counsel for the respondent wants to make a statement to the effect that:-- ' BBC has communicated to the respondent/Authority on the 13th November, 2006 by E-Mail that the BBC agreement with MAST FM-103, has come to an end because of force majeure events and that the same has been communicated to MAST FM-103 as well and that presently an agreement is being arrived at between the respondent/authority and the BBC under which local FM Radio Stations will be allowed to air or rebroadcast the BBC service, subject to certain conditions, the modalities whereof presently are being settled and negotiated between BBC and PEMRA (Pakistan Electronic Media Regu atory Authority).

2. According to the learned counsel since the agreement between BBC and the petitioner has ceased to exist, this petition has become infructuous as the petitioner has lost locus standi to maintain the same.

3. ' The position stated above by the learned counsel for the respondent remains uncontroverted. In such view of the matter this petition has lost its efficacy. It is dismissed as having become infructuous with an option open to the petitioner to seek 'revival of the petition through an application, if his agreement with the BBC has not been rescinded as stated by the counsel for the respondent and cause of action still subsists.
