' ASIF SAEED KHAN KHOSA, J.---Through this petition Mst. Kalsoom Bibi petitioner has sought pre- arrest bail in case F.I.R. No .346 registered at Police Station Raiwind Sadar, District Kasur on 31-7- 2005 in respect of an offence under section 324, P.P.C. During the investigation section 324, P.P.C.
Was deleted from the F.I.R. And the same was substituted by section 302/34, P. P. C. Earlier the petitioner had approached the Court of Session, Kasur for her pre-arrest bail but that, petition was dismissed by the learned Additional Sessions Judge, Kasur vide order dated 12-12-2005. Hence, the present petition before this Court.
2. After hearing the learned counsel for the parties and going through the record it has straightway been noticed by me that no allegation had been levelled against the petitioner in the F.I.R. And she had been implicated in this case at a later stage with an allegation of applying Japha to the deceased so as to facilitate her co-accused in stabbing the deceased. The learned counsel for the State has pointed out that the petitioner has already joined the investigation and nothing is to be recovered from her custody. He has gone on to submit that during the investigation it has been found that the petitioner was merely present at the scene of the crime at the relevant time and had committed no overt act at all. Belated implication of the petitioner in the case in hand and exaggeration found by the local police vis-a-vis the allegation levelled by the complainant against the petitioner prima facie hint at male fide of the complainant party against the petitioner. The petitioner is a woman and by virtue of her gender she is entitled to a concessionary treatment in the matter of bail.

For what has been observed above this petition is accepted and the ad interim pre-arrest bail already allowed to the petitioner by this Court vide dated 19-12-2005 is hereby confirmed subject to furnishing for a fresh bail bond by the petitioner in the sum of Rs,50,000 (Rupees fifty thousand only) with one surety in the like amount to the satisfiaction of Area Magistrate of Police Station, Raiwind Sadar, District Kasur within a period of two weeks from today.
