1. ' MUHAMMAD MOOSA K. LEGHARI, J.-- Petitioner Mrs. Nusrat Munir Gondal has filed this succession miscellaneous application with a prayer to grant Letters of Administration as well as Succession Certificate in his favour pertaining to the immovable Property bearing Plot No,28-B, Muhammad Ali Cooperative Housing Society, Karachi left by her deceased mother namely Taj-un-Nisa Begum; The petitioner has stated that the deceased died on 13-3-1995 leaving behind him the petitioner and 2 legal heirs named as under:--
(1) Najmul Hussain Atta Son
(2) Ijaz Hassan Atta Son It is further stated that the deceased died intestate and due and diligent search has been made to find out any Will which have been made by him but none is found; further no other Letters of Administration/ probate or Succession Certificate is issued by any Court with regard to the said property left by the said deceased.
2. 'Affidavits of other local heirs of the deceased namely, Najam Hassan Atta and Ijaz Hassan Atta have filed with this S.M.A. Wherein they have stated no objection to the grant of the Letter of Administration in favour of the petitioner. They also appeared before the Court and confirmed the contents of their affidavit.
3. ' Notice of this petition was got published in the newspaper viz. Daily "Jang", Karachi in its Issue of 11th May, 2006 to invite objections against the same from the interested persons but none has come forward to file such objections.

' Under the circumstances this S.M.A. Is granted and Letter of Administration pertaining to the immovable property detailed above left by the deceased is directed to be issued in the name of the petitioner provided that he shall furnish administration bond for the purpose of section 291 of the Succession Act for the value of the said immovable property to the satisfaction of Nazir of this Court.
