' MUHAMMAD JEHANGIR ARSHAD, J.---This writ petition calls in question the judgment dated 15-6- 2005 passed by learned Additional District Judge, Ahmadpur East whereby the learned Additional District Judge while allowing appeal of Mst. Anjum Firdous respondent No,1 against the judgment and decree of the learned trial Court/Judge Family Court dated 26-11-1997 dismissing suit of respondent No,1 for maintenance, allowed her maintenance allowance at the rate of Rs,1,000 per month from the date of institution of the suit.

Admittedly the parties are entangled in litigation since 1997 to-date, and in the meanwhile the petitioner after obtaining permission from the Arbitration Council in terms of section 6 of the Muslim Family Laws Ordinance dated 9-8-2000, against which the respondent No,1 filed no revision, contracted second marriage and is now enjoying matrimonial life begetting three children from his second wife, whereas Mst. Anjum Firdous respondent No,1 is being kept in matrimonial bond without any reason, therefore, when suggested by this Court to the learned counsel for the petitioner, whether the petitioner is ready to divorce respondent No,1 in lieu of one-half of the amount of maintenance decreed by learned Additional District Judge on 15-6-2005 from the date of institution of the suit in lieu of consideration for Khula, the learned counsel in the presence of the petitioner half-heartedly showed his consent with the request that maintenance allowance as determined by the learned Additional District Judge at the rate of Rs,1,000 per month be reduced to Rs,800 per month. As the above suggestion as well as the request of learned counsel for the petitioner is acceptable to Mst. Anjum Firdous respondent No,1 present in Court along with her counsel, this writ petition therefore, is disposed of in the following terms:--
(i) The amount of maintenance allowance as fixed by the learned Additional District Judge dated 15-6-2005 at the rate of Rs,1,000 per month is reduced to Rs,800 per month payable by the petitioner to respondent No,1 from the date of institution of the suit, till date;
(ii) The marriage between the parties shall stand dissolved from today in lieu of surrender by Mst.
Anjum Firdous respondent No,1 her right of maintenance at the rate of Rs,400 per month from the date of institution of the suit in lieu of consideration for Khula; and
(iii) Mst. Anjum Firdous respondent No,1 however, shall be entitled to recover the maintenance allowance from the petitioner at the rate of Rs, 400 per month till 30-6-2006 viz._ including the period of Iddat from today.
