1. ' SHABBIR AHMED, J.--- The applicants were granted interim bail before arrest by this Court vide order dated 26-5-1997. The application has come for the confirmation. During the arguments it has been contended that the complainant Ahmed Ali was not satisfied with the investigation of Crime No,4 of 1997 of Police Station Oderolal and has filed a direct complaint which is pending disposal before IVth Additional Sessions Judge, Hyderabad. It has also been stated by the counsel for the applicants that all the applicants are on bail in the direct complaint filed by the complainant. In this case the charge-sheet has been submitted against the applicants but it cannot proceed in view of the dictum laid down by the Supreme Court that the private complaint case arisen out of the direct complaint is to be tried first. Since the applicants are already on bail on the same facts in direct complaint case I, therefore, confirmed the interim bail granted by this Court on the same terms and conditions.
