1. MUSHIR ALAM, J. - It appears that Petitioner seeks directions for removal. Of the encroachment on the road. It appears that some open piece of land in front of the Petitioner and Respondents' plots is cause of dispute between the parties. It appears that both of them have an eye on such open plot. Mr. Manzoor Ahmed, learned counsel appearing for CDGK submits that encroachment in the surrounding area has been removed and open plot is owned by Katchiabadi Authorities or Government of Sindh, therefore, they may take appropriate action for protection of their property.
2. Under the circumstances, . This Petition is being disposed of along with miscellaneous pending applications with directions that both the parties namely Petitioner and Respondent No. 1 are restrained from encroaching or occupying the open plot/area beyond their leased plots. Official Respondents may take appropriate steps to protect the property and deal with in accordance with law.
