1. Azman Ahmed S/o Nazar Muhammad, complainant filed complaint in hand under section 25 Punjab Consumer Protection Act, 2005 before this court with the prayer that the respondent be directed to replace the defective mattress and he be also directed to pay compensation 1,00,000/- rupees.

The brief facts relevant for the disposal of this complaint are that on 27-01-07 complainant purchased one supreme spring mattress 1-72-78 in sum of 5600/- after few days of purchase the mattress changed its shape. The complainant contacted with the respondent No. 1, and requested him for the change of the mattress. The respondent did not pay heed at the request of the complainant. Due to this transaction the complainant suffered mental shock. The complainant sent a legal notice under 28 (1) Punjab Consumer Protection Act, 2005 but the respondent had not reply the same. Therefore, the complaint in hand arises.
3. The respondent was summoned and he put his appearance on 22-05-07. On 12-06-07 both the parties entered into compromise and the complainant filed application under section 29 of Punjab Consumer Protection Act, 2005. Both the parties were directed to make a firm written offer regarding their settlement and they were also directed to state the condition of their settlement.
4. Through the written offer mark "A" respondent offered that he is ready to replace the mattress to the complainant and as well as fee of the counsel. The complainant vide his written acceptance mark "B" accepted the offer.
5. The complainant stated before the court that he received the replaced mattress and as well as fee of the counsel amounting Rs. 2000/- and in this regard issued receipt mark "C".
6. In view of the settlement between the plaintiff and defended the grievances of the complainant has been redressed however the respondent is directed to be careful in future. With these observations this complainant is disposed of. File be consigned in the record room after due completion.
