' Office objection overruled.
2. The petitioner earlier filed petition No,D-26 of 2003 seeking the same relief as in this petition and the petition was allowed on 25-4-2003. The earlier order of this Court reads as follows:-- "25-4-2003.

2. The comments have been filed on behalf of respondents wherein it is stated that the case of petitioner has been recommended but since there is ban on fresh appointment and no post is lying vacant therefore they have not been able to consider the case of petitioner. However, Mr. Muhammad Bachal Tonyo learned Addl. AG. Concedes that as and when post falls vacant and the ban is lifted the petitioner will be considered for appointment on merits in the light of the order already passed by the Chief Secretary.
' Accordingly, the petition is allowed in the terms that within the meaning of Rules 10-A and 11-A of Sindh Civil Servants (Appointment, Promotion and Transfer) Rules, 1974 petitioner shall be appointed as and when the post falls vacant and the ban is lifted. The petition stands disposed of."
' The petitioner has filed this second petition for the reason that vide advertisement in Daily Kawish dated 6-3-2005 two posts of Office Assistant, in Agriculture Extension Sindh have been advertised without issuing appointment letter to the petitioner.
' The learned Addl. A.-G. Has reiterated that as and when any appointment is made the petitioner shall be appointed first and thereafter other persons shall be appointed. The learned Addl. A.-G.
Has further submitted that ban is still continuing on the appointment and no other person has been appointed after earlier petition of the petitioner was allowed. The learned counsel for the petitioner appears to be satisfied with the statement made by the learned Addl. A.-G. However, we can realize anxiety of the petitioner as it appears that there are two vacancies only and both the vacancies have been advertised. In terms of the earlier order of this Court the petitioner is to be appointed against one of the posts and therefore, the department ought to have advertised one post only. We therefore, direct that selection for the post of Office Assistant shall be made against one post only in case there are two vacancies. If there are more than two vacancies then after appointment of the petitioner selection can be made for the two or more posts as deemed fit.
' The petitioner is directed to approach the Director-General Agriculture Extension Sindh Hyderabad who is stated to be appointing authority in connection with the compliance of direction given in the earlier petition and the present petition. The petition stands disposed of accordingly.
