ORDER IFTIKHAR HUSSAIN CHAUDHARY, C.J.- Petitioner seeks transfer of suit titled "Muhammad Kashif Aqeel Khan Vs. Mst. Aneeia Arshad Khan"

(suit for restitution of conjugal rights) from Family Court, Lahore to Okara and also a guardian petition having the same title from the Court of Guardian Judge-II, Lahore to Okara.

2. Notice of the petition was issued to respondent.

3. Learned counsel for the respondent opposed the prayer made by the petitioner on the ground that petitioner could conveniently defend the suit/petition at Lahore and, moreover, suit filed by her for dissolution of marriage stood decreed and, therefore, suit/petition instituted by respondent need not be transferred to Okara for any purpose.

4. The petitioner, admittedly, is resident of a Chak near Akhtar Abad, Tehsil Renala Khurd, District Okara. The minors are living with their mother. Therefore, keeping in view the fact that ordinary place of residence of petitioner was a locality in District Okara, the application is allowed.

5. Suit titled as "Muhammad Kashif Aqeel Khan Vs. Mst. Aneela Arshad Khan" (suit for. Restitution of conjugal rights) is withdrawn from the Court of Mr. M. Moeen Khokhar, Judge, Family Court, Lahore and is transferred to the Court of Syed Muhammad Omer, Judge, Family Court, Okara. Likewise, guardian petition titled "Muhammad Kashif Aqeel Khan Vs. Mst. Aneela Arshad Khan" (petition under Section 25 of the Guardian and Wards Act, 1890) is withdrawn from the Court of Mr. Abdul Razzaq, Guardian Judge-II, Lahore and is transferred to the Court of Syed Muhammad Omer, Judge, Family Court/Guardian Judge, Okara.
