1. ' The petitioner was admitted to First Year of M.B.B.S. Class in Punjab Medical College, Faisalabad.
2. She passed First Professional M.B.,B.S. Part-I Examination held in September, 2004 under Roll No,32.
3. Thereafter, she appeared in the First Professional M.B.B.S. Part-II Examination, exhausted all the chances but could not qualify the said exam. Learned counsel for the petitioner contended that atleast two students namely Syed Hammad Bin Hamid and Fatima Hina Sharif were allowed fifth chance to clear the First Professional Examination and that two other students were allowed to appear under the orders of the Court.

' Conversely the learned counsel for the respotdent University submitted that a candidate who fails to pass First Professional Part-II Examination in three consecutive chances, availed or unavailed, after becoming eligible for the said exam. Shall cease to become eligible for further medical education. The students who were granted the fifth chance belonged to the old course.
2. We have considered the arguments of the learned counsel for the parties and gone through the relevant rule. Admittedly the petitioner has exhausted all the three chances but remained unsuccessful in the First Professional M.B.B.S. Part-II Examination. Fourth chance is not permissible under the rules. Fifth chance granted to the students was under the old course as per argument of the learned counsel for the University which the learned counsel for the petitioner has not been able to controvert. No indulgence is called for in the instant case. This petition has no merit and is dismissed.
