Briefly stated the facts giving rise to the present appeal are that the appellant had joined Education Department Narowal on 17.4.1993. Later on p DPI Punjab transferred the appellant from Narowal to Model High School Model Town, Lahore vide order dated 6.8.2001, copy appearing at page 21 of the appeal where the appellant had been performing his duties. Yet again the DPI transferred the appellant from Lahore to Narowal District vide order dated 12.10.2002, copy appearing at page 23 and 24 of the appeal. It was specifically mentioned that the seniority of PTC, PTSV, OT, AT and SST shall be placed at the bottom of the seniority list of their cadre in the concerned district. Accordingly the appellant was adjusted at Govt. High School Sadauwala as SV teacher vide order dated 13.11.2002, copy appearing at page 25 of the appeal. It was alleged that in the year 2004 applications were invited for absorption as SST. The appellant applied for the same through proper channel. However the appellant was ignored that on his transfer from Lahore to Narowal he was placed at the bottom of seniority list in his own cadre. Feeling aggrieved the appellant filed an appeal which was not disposed of within the statutory period, hence the present appeal.
2. I have heard the arguments of the learned counsel for the appellant, the learned District Attorney and have gone through the record. The learned counsel for the appellant invited my attention to the judgment of the Hon'ble Chairman, Punjab Service Tribunal in Appeal No, 2631 of 2003. However, I find that the matter in dispute was not the same which was subject matter in the above said appeal. No conclusive finding was given with regard to the points in issue in the present case. The learned counsel has relied upon the policy letter dated 14.6.2002 and maintained that the seniority was to be prepared as per date of entry in the Education Department which in the case of appellant was 1993. However in the said policy letter in the note it was specifically mentioned that the first date of entry will be the date of joining in the next district where the teachers were accommodated On transfer. As per order dated 12.10.2002, copy appearing at page 23 of the appeal it provided that seniority list of PTC, PET, SVOT, AT and SST shall be placed at the bottom of the seniority list of their cadre in the concerned district. The learned counsel for the appellant contended that through the impugned order the period spent on duty at Lahore was excluded from the service of the appellant. This contention is devoid of substance. The period, of service was to be calculated towards pension. When the appellant was transferred from Lahore to Narowal he was rightly placed at the bottom of seniority in his cadre.
As a result of above discussion I find no substance in the present appeal which fails and is dismissed.
