MOAZZAM HAYAT, MEMBER. -Appellant Qamar- uz-Zaman is aggrieved as promotion to BPS-20 was denied to him. It appears that he was superseded for the reason that he did not enjoy good reputation. The appellant has submitted that he had never been conveyed any adverse remarks regarding his integrity and general reputation. This fact is not denied by the departmental representative, it is also admitted that the adverse remarks given to the appellant were subsequently washed on his representation, the service record of the appellant is thus clear, therefore, he should have been given a meaningful consideration for promotion/seniority by the Departmental Promotion Committee on , the basis of tangible evidence and on justiciable reasons.
We accordingly direct the respondents to reconsider the claim of the appellant for seniority and promotion by ignoring the allegation with regard to general reputation.
2. The respondents are under a legal obligation to maintain the seniority list of the officers. They shall perform this duty of theirs and prepare that list without further delay. The matter shall be decided preferably within a period of three months.
3. With this direction the appeal is disposed of. Parties be informed.
