1. ' The petitioner has challenged proceedings in the private complaint titled Muhammad Nazir v.
2. Hafeez Khan and others pending in the Court of Judicial Magistrate, Faisalabad, through the instant petition.
3. ' The brief facts of the case for disposal of the petition are that the petitioner contracted marriage with respondent No.1 on 26-1-2000 after divorce from her first husband Muhammad Tufail. The dispute arose between the petitioner and respondent No.1, on which, she filed a suit for dissolution of marriage on 1-4-2003 before the Family Court, Lahore (Annex-A) which now, according to the learned counsel, has been decreed. Respondent No.1 appeared before the Family Court and case was adjourned for filing written statement and he filed instant complaint as a counterblast against the petitioner as well as her witnesses as given in the schedule of the petition in the complaint to be produced in her support. The allegations against the petitioner and co-accused as per complaint are that they induced and abducted the complainant and took away household articles. The Judicial Magistrate after recording the preliminary statement on 19-3-2003 summoned the petitioner and her other relatives, therefore, it has been prayed that the proceedings be ordered to be quashed.
3. Respondent No.1 despite service of the notice has not turned up, therefore, he is proceeded against ex parte and arguments of learned counsel for the petitioner have been heard. Professor Javid Jiwan Mall and others 1986 M LD 2203, Mazhar Ibnehassan Siddiqui and 2 others v. The State and another 1997 PCr.LJ 1030, Tasleem Begum and 6 others v. Inayat Ullah and 2 others PLD 1987 Lah. 212, Abdul Rashid and 2 others v. The State and another 1987 PCr.LJ 1380, Jan Muhammad and others v. Gaman Khan 1995 PCr.LJ 1371, Mst Nasim Bano and 2 others v.
4. Muhammad Ismail and another 1980 PCr.LJ 1189, Anand Ram v. Moti Ram and 3 others PLJ 1988 Cr.0 (Quetta) 1, Sher Muhammad and another v. The State and another 1996 PCr.LJ 2000 and Muhammad Anwar v. The State and another 1980 PCr.LJ 823, has argued that false complaint has been filed to pressurize the petitioner to withdraw from the suit for dissolution of marriage. The witnesses of the petitioner have also been roped in and in the precedent case such-like proceedings have been quashed by this Court.
5. ' Learned Law Officer after going through the record being fair enough has conceded to the request of the petitioner.
6. ' I have heard learned counsel for the petitioner as well as learned. Law Officer and also examined the record.
7. The petitioner has filed suit for dissolution of marriage on 1-4-2003. Thereafter, the complaint was filed by respondent No.1 at Faisalabad on 16-4-2003 which shows that after receipt of the notice he has filed the complaint with false allegations and following the consistent view of his Court in the cited precedents in similar circumstances, I allow this petition and the proceedings pending in the case before the Judicial Magistrate Faisalabad are ordered to be quashed.
