ORDER

1. ' Through this application learned counsel for the applicants submits that he wants to withdraw revision application and Court-fee amounting to Rs,9,560 may be refunded to the applicants. It is contended that this revision application was filed on 19-7-2003 but due to financial position applicant could not arrange the required Court-fee and filed application for extension of time and then affixed the required court-fee. In the meanwhile the respondents already filed application for winding up respondents' Company on 4-6-2002 prior to filing J.M. 25 of 2002 in this Court and obtain decision on 21-4-2004 from the Court of learned Additional District Judge. The applicant was unaware about the order sought by respondents but the applicant presented this revision and paid Court-fees. Learned Assistant Advocate-General does not oppose for return of Court-fee as the learned counsel for the applicants does not press and withdraws this revision application as the case has not been heard on merits and pre-admission notice issued to respondents and then on 12-11-2003 Mr. Aftab Ahmed Soomro appeared in Court and undertook that power will be filed on behalf of respondents on the next date of hearing then on 24-12-2003 Mr. Aftab Ahmed Soomro appeared in the Court and matter was adjourned. On 9-4-2004 Mr. Soomro was called absent and notice was also issued for his appearance. The matter was adjourned to 21-4-2004 then on 21-4- 2004 by consent the matter was adjourned to 11-5-2004 and on 11-5-2004 notice was issued to learned Advocate-General, Sindh. The matter was not heard at all on merits.

2. ' Learned Assistant Advocate-General has not opposed for return of Court-fees as learned counsel does not press this revision application.

3. ' Office is directed to return original court-fee Stamp Papers to the applicants for getting the amount/refunded by the competent authority and necessary certificate may be issued.

4. ' R.A. No,197 of 2003 stands disposed of.
