ORDER

C.M. No.1-C of 2005 Instant application has been filed on behalf of the respondent-Bank with the prayer that Bank may be allowed to place on record copy of letter dated 13-6-2003, containing the terms and conditions of the contract, statedly, entered between the parties. It has been stated in the application that the appellants offered to settle the matter under Circular No.29 dated 15-10-2002, and the offer was accepted by the respondent-Bank, which resulted in issuance of letter dated 13-6-2003. Let this letter be placed on record subject to all just and legal exceptions. C.M. stands disposed of.

2. Let the main appeal be taken up for hearing today, at the joint request of both the learned counsel.

3. Both the learned counsel state that the parties have amicably settled the subject-matter of the appeal. The learned counsel for the appellants, while placing on record photocopy of pay order, has further submitted that pursuant to the arrangement entered between the parties, the appellants have paid a sum of rupees one million to the respondent-Bank.

4. In view of the above, as the subject-matter of the appeal has amicably been settled between the parties, therefore, we feel that no live issues are left to be decided by this Court and the appeal has become infructuous. However, if the appellants feel that some issues are still undecided, in that case they can file an appropriate application to reactivate the proceedings in the appeal within a period of three months from today. Office is to retain the record of this appeal for three months.

Appeal stands finally disposed of having become infructurous.
