JAWWAD S.KHAWAJA, J.-- This writ petition seeks quashment of case FIR No. 293/2004 filed against the petitioner on the complaint of respondent No. 2. Learned counsel for the petitioner has mainly contended that the dispute between the parties relates to Warabandi, which is subject-matter of litigation pending in the Civil Court. He therefore, argued that the criminal case was liable to be quashed.
2. Mere pendency of civil litigation is not sufficient for quashing a criminal case. I have heard learned counsel for the petitioner at length, but have deliberately refrained from commenting on the arguments advanced by him, because it will be open to the petitioner to produce the relevant record of the civil litigation before the Investigating Officer. This petition, however, being without merit, is dismissed.
