' The petitioner has sought his pre-arrest hail in case F.I.R. No.47 registered at Police Station Kot SamaLa on 7-6-2003 for offences under sections 452/148/149/380, P.P.C.
2. Briefly, the allegations as levelled in the F.I.R. Are that eleven accused including the petitioner whose age is more than 70 years trespassed into the land of the complainant and took away buffalo-calf of the value of Rs.2000 along with them.
3. I have heard the learned counsel for the parties and have also A gone through the record of the case. It has been noticed that the matter was reported to the police after a delay of four months; the petitioner has already jointed the investigation; there is no specific allegation against the petitioner and in the first round of investigation he was found innocent. In the above-mentioned circumstances, I confirm the ad interim pre-arrest bail already granted to the petitioner vide order dated 27-5-2003 subject to his furnishing fresh bail bond in the sum of Rs.10,000 (Rupees ten thousand only) with one surety in the like amount to the satisfaction of the trial Court within two weeks.
