M.A. SHAHID SIDDIQUI, J.-- Ahmad Nawaz petitioner has been arrested on the basis of cross version of the occurrence reported by Muhammad Mumtaz s/o Muhammad Amir on 16.11.2004 vide FIR No. 198, dated 16.11.2004 under Sections 324/337-A(ii)/337- F(i)(vi)/148/149, PPC. The petitioner is accused of causing fire arm injury on the right ankle of Gulzar, PW.
2. According to the FIR Muhammad Naeem s/o Mansab Khan had received a fire-arm injury on his left shine at the hand of Ahmad Shafi, who has been admitted to bail.
3. I have heard the learned counsel for parties and have perused the record. Ahmad Nawaz, petitioner, caused one fire arm injury on the ankle of Gulzar, In the same occurrence Muhammad Naeem had sustained fire arm injury oh his shin at the hands of Muhammad Shafi. It is yet to be established at the trial as to which party was the aggressor and that the petitioner caused the injury with the intention to commit "Qatal-i-Amd'. The petitioner is in judicial Lock-up. The injury sustained by Gulzar entails punishment up. To seven years as such the petitioner's case does not fall within prohibitory clause. He is, therefore, ordered to be released on bail subject to furnishing bail bond in the sum of Rs. 50,000/- (Fifty thousand only) with one surely in like amount to the satisfaction of the Trial Court. revisions by the competent authorities.
