' This appeal under section 3 of the Law Reforms Ordinance 1972 has been preferred against the judgment dated 21-4-2004 passed by learned Single Judge in Chambers.

Syed Waqas Noor Bukhari, appellant applied for admission in Electrical Engineering Department of Bahauddin Zakria University Multan for a reserved seat on self finance basis for the Session 2003-04. The appellant was refused admission. Subsequently there was an increase of 5 seats against which four other candidates were admitted but the petitioner was not accommodated.
The petitioner challenged the decision of the Admission Committee through W.P. No.4736 of 2003 which was disriiissed on 11-12-2003. An appeal under section 3 of the Law Reforms Ordinance, 1972 was preferred which the appellant opted to withdraw in order to avail the remedy of appeal. The Appellate Admission Committee dismissed the appeal on 28-1-2004. Feeling aggrieved the appellant challenged the same through W.P. No.701 of 2004 which a learned Single Judge of this Court was pleased to dismiss vide impugned judgment. Hence this appeal.
3. Learned counsel for the respondent at the very out-set objected to the maintainability of the appeal mainly on the ground that the order which was challenged through the W.P. No.701 of 2004 was passed by the Appellate Admission Committee as such the judgment of the learned Single Judge, in Chambers of this Court cannot be challenged under the , proviso of subsection (2) of section 3 of the Law Reforms Ordinance, 1972.
4. Learned counsel for the appellant argued that the Appellate Admission Committee had no statutory basis as such the appeal filed by the appellant before Appellate Admission Committee would not be treated as a remedy available to the appellant under the law.
5. Learned counsel for the respondent argued that the appellant had challenged the decision under Regulation No.13 framed by the competent authority under sections 31 and 32 of the B. Z . U.
Act, 1975.
6. We have considered the arguments put forth by the learned counsel for the parties. Admission to the different programmes of the University are regulated by the regulations published in the prospectus of B.Z.U. For the year 2003. These Regulations prescribe the minimum qualifications and the method such as entry test for admission to various faculties in the University. If the applicant has any grievance he can prefer an appeal to the Appellate Admission Committee of the University under Regulation 13 which reads as under:- "(13) Appeal ' There shall be an Appellate Admission Committee of the University for hearing, the appeals of the aggrieved persons regarding admission in any discipline."
7. Admittedly the order dated 28-1-2004 was passed by the Appellate Admission Committee on an appeal filed by the appellant. The regulations have been framed by the Syndicate under section 32 of the B.Z.U. Act 1975, as such, it cannot be said that the regulations have no statutory basis. We are of the considered view that this appeal is not maintainable accordingly it is dismissed.
